The contract, in full and up front
The whole contract, with its three annexes, is published before we ask you for anything. This page explains it in English, clause by clause. If something does not sit right, tell us and we will talk about it.
From interest to signature, in three steps
You read it
It is published here and as a PDF. There is no small print somewhere else, and no conditions that appear later.
You accept it or you sign it
The Club plan is self-service: you accept these terms when you pay, and that acceptance counts the same as a signature. The Club + plan is signed electronically, because it involves bespoke set-up.
We activate the plan
We charge nothing before signature. And there is no lock-in: cancellation takes fifteen days' notice.
Three things worth seeing
- Annex I says what the software does NOT do. Tournament draws, league calendars, standings, automatic reminders… It is written down in black and white so nobody subscribes expecting something that does not exist.
- Your players' money does not pass through us. You collect through your own card terminal. We are not a payment intermediary, and that protects you too.
- Your players' data is yours. Annex II is the data processing agreement: we do not contact your players, we do not cross data between clubs and we export everything to you when you leave.
What the contract says
1–2 · Subject, and what is included
The client subscribes to the plan set out in Annex III. The exact description of what the service does — and does not do — is Annex I, which forms an inseparable part of the contract. Where any commercial material (this website, emails, presentations, conversations) contradicts Annex I, Annex I prevails. The provider makes no representation about features that are not expressly listed there, and the client is not subscribing on the strength of any future feature or roadmap.
3 · How the contract comes into force
Two routes with identical legal value: express acceptance of the terms when subscribing through the payment gateway in self-service (the Club plan route), or electronic signature of the document (the Club + route, available to anyone who prefers it). The version in force is the one published at mixines.com/contrato/, identified by its version number; earlier versions are kept on record.
4 · Onboarding
The provider activates your installation within five working days of signature and first payment. Set-up includes an online training session of roughly twenty minutes at no extra cost. Activating card payments requires you to supply the credentials of your own virtual terminal; obtaining and maintaining that terminal is your responsibility, and your bank may refuse or revoke it for reasons outside the provider's control.
5 · Player money does not pass through the provider
This clause is essential and you confirm you understand it. Payments from players go directly into your own virtual terminal, contracted by you with your own bank. The provider is not a payment institution, agent or intermediary, and at no point receives, holds, transmits or refunds player funds. Refunds, chargebacks, disputes, bank fees and the tax obligations arising from those payments are entirely yours. The provider is not liable for incidents attributable to the payment gateway, your bank or the card network.
6 · Price, billing and price review
The price is the one in Annex III, excluding VAT, which is charged at the rate in force. Billing is in advance, monthly or annually as chosen. Non-payment of a due invoice entitles the provider to suspend the service after seven calendar days' notice by email; suspension does not waive amounts already accrued. The provider may review the price once every twelve months, with thirty calendar days' notice. If you do not accept the new price you may terminate without penalty before it takes effect.
7 · Term and cancellation
No minimum term. Cancellation with fifteen days' notice, taking effect at the end of the paid period.
8 · Your obligations
Use the service lawfully and in line with the contract. Look after the organiser credentials and do not share them outside your organisation — the provider is not liable for what is done with credentials correctly delivered to you. Inform your players about the processing of their data and obtain the necessary legal bases where applicable; you are the data controller for that data (see Annex II). Do not enter special-category data (health, beliefs and so on): the service is not designed to handle it. Provide accurate billing information.
9 · Availability
The provider will use reasonable means to keep the service available but does not guarantee an uptime percentage and does not offer a service level agreement. There is no committed response time and no penalties for unavailability. The service relies on third-party infrastructure; an outage attributable to them does not create liability beyond clause 11. Support is provided on working days during office hours (Spanish mainland time), by email and, on plans that include it, by WhatsApp.
10 · Changes to the service
The provider may develop the service. If a change removes or substantially degrades a feature listed in Annex I, it will be notified thirty days in advance and you may terminate without penalty, recovering the unused portion.
11 · Liability
The provider is liable only for direct damages attributable to it through wilful misconduct or gross negligence. Total accumulated liability is capped at the amounts actually paid by the client in the twelve months preceding the event. Indirect damages, loss of profit, loss of customers, data loss attributable to the client or third parties, and losses arising from service interruption are excluded. These limits do not apply where the law does not permit limitation, in particular in cases of wilful misconduct or harm to life or personal integrity. You will hold the provider harmless against third-party claims — including from your own players — arising from your use of the service, the content you publish or your breach of your obligations.
12–13 · Intellectual property and confidentiality
The service, its code, its design and its brand belong to the provider; the contract transfers no ownership, only a right of use while it is in force. The data you enter is yours. You authorise the provider to cite your name and logo as a commercial reference — revocable at any time by writing to hola@mixines.com. Both parties keep non-public information confidential during the term and for two years afterwards.
14–20 · Data protection and general terms
Data processing is governed by Annex II, a processing agreement under article 28 of Regulation (EU) 2016/679. The remaining clauses cover assignment, force majeure, the commercial (non-consumer) nature of the agreement, notices, partial invalidity, and applicable law: Spanish law, with the courts of the provider's registered address.
What the service does not do
This is the part most worth reading. It is in the contract precisely so that nobody buys expecting something that is not there.
| Not included | What that means |
|---|---|
| Tournament draws, league calendars and standings | The service handles sign-up and payment for a tournament, not the competition itself. The draw, the schedule and the table are yours to run. |
| Round-by-round league management | There is no fixture calendar and no result tracking. |
| Team entry and company invoicing | The service issues no invoices and does not manage corporate teams. |
| A slot for a sponsor's logo | It does not exist in the interface. |
| Several separate organiser codes | There is one code per installation, which you can share inside your organisation. |
| Automatic reminders to players | There are no scheduled emails, SMS or notifications. |
| Automatic or scheduled data export | Export is requested from the provider and delivered manually. |
| Automatic release of unpaid places | The organiser removes the player manually. |
| Refunds from the panel | Refunds are issued from your own card terminal. |
| Court booking | The service does not replace your booking system and does not manage court occupancy. |
| A native App Store or Google Play app | It is a web application. |
| Automatic match and court assignment inside an event | Not implemented. |
| An English organiser interface | The list your players read is in Spanish and English, with a button to switch. The organiser screens — settings, subscription, contract and manual — are Spanish only. |
Who owns the players' data
Annex II is the data processing agreement required by article 28 GDPR. In plain terms: the club is the controller and Argentina Pura S.L. is the processor. We process player data only on your instructions and only to run the service. We do not use it for our own purposes, we do not contact your players, we do not combine data between clubs, and we return or delete it when the contract ends. Sub-processors are limited to hosting and email (Hostinger, Lithuania) and subscription billing (Stripe, Ireland), all within the EU. Player payments do not reach us: they go to your terminal via Redsys, which acts as an independent controller.
Annex IIIPlan and price
Annex III records the plan you have contracted, what it includes, how it is contracted (self-service for Club, electronic signature for Club +), the 30-day Club trial every new sign-up starts with, and the commercial terms: price excluding VAT, billing in advance, no minimum term, and the commitment to allocate 1% of every subscription to permanent CO₂ removal through Stripe Climate. The current figures are on the pricing page.
Does it fit? We will send it over to sign
Read it first, ask whatever you need to, and only then decide. Nothing is charged before signature, and the free plan carries no contract at all.
